Certificates of Lawfulness

Local planning authorities often encourage (or require) the submission of a Certificate of Lawfulness for an Existing Use or Development (CLUED) in the case where a development already exists, or a Certificate of Lawfulness for a Proposed Use or Development (CLOPUD).

This type of application has been specifically designed to be as straightforward as possible to submit but the consideration and determination of such applications is extremely subtle. If submitted without having a full appreciation of the risks it can be extremely damaging to your interests in terms of future development potential and more importantly, in terms of land value or other financial implications.

We cannot stress strongly enough the need to discuss the situation with a town planning consultant to obtain professional advice and guidance before you consider submitting such applications.
